Terms & Conditions

Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of our website, products, and services. By accessing or using our site, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use this site. All orders are accepted and handled in accordance with these Terms.

1. Governing Law and Jurisdiction

These Terms are governed by the laws of Australia. You and Toast agree to submit to the non‑exclusive jurisdiction of the courts of Australia. If you access this site outside Australia, you are responsible for compliance with local laws.

2. Revision to Terms

Toast may revise these Terms at any time by posting updated terms on our website. Any revisions are effective immediately upon publication. If any part of these Terms is found unenforceable, the remainder will continue in full force. By continuing to use the site after changes are made, you agree to be bound by the revised Terms.

3. Products and Orders

When you place an order through our website, you are making an offer to purchase the product at the price displayed at the time of order. By placing an order, you agree to pay for and accept delivery unless Toast confirms cancellation in writing before dispatch. Prices may change at any time, including for items in your basket that have not yet been paid for. Toast reserves the right to accept or reject any order for any reason, including product unavailability, errors in price, image, or description, or mistakes in your order. We may also require additional verification before accepting an order.

4. Price

All prices are listed in Australian dollars and include GST unless otherwise specified. Prices and availability may change without notice. Toast reserves the right to limit sales, including prohibiting sales to resellers, where permitted by law.

5. Delivery and Risk

Title to products passes to you once the product has been received. Risk in the product passes to you upon delivery to your nominated address. If you authorise delivery without signature (“Authority to Leave”), products are deemed received once left at your premises. Toast and its contractors are not responsible for any loss or damage arising from this delivery method.

6. Refunds and Cancellations

Toast is not required to provide refunds if you change your mind. Refunds or cancellations are only available where required under the Australian Consumer Law, such as in the case of a major fault, a minor fault that cannot be fixed within a reasonable time, or if our products fail to meet consumer guarantees.

7. Product Use and Safety

Toast products are intended for external use only. They must not be ingested and should be kept out of reach of children. Customers must follow all usage instructions provided with the product carefully.

8. Allergy and Patch Test

Because individual skin types vary, Toast recommends performing a patch test before full use. Toast is not liable for allergic reactions, sensitivities, or other adverse effects resulting from use of our products.

9. Medical Disclaimer

Toast products are cosmetic in nature and are not intended to diagnose, treat, cure, or prevent any medical condition. Customers with skin conditions or concerns should seek advice from a qualified healthcare professional before use.

10. Results Disclaimer

Tanning results may vary depending on skin type, preparation, and application method. Toast does not guarantee uniform or identical results for all customers.

11. Storage and Expiry

Products should be stored in a cool, dry place away from direct sunlight and used within the recommended timeframe. Toast is not responsible for misuse or use of products beyond their expiry date.

12. Misuse and Liability

Toast accepts no responsibility for damage caused by misuse of products, including staining of clothing, bedding, or other materials, or improper application contrary to instructions.

13. Intellectual Property and Copyright

All content on this site, including text, graphics, logos, icons, images, video, audio, and software, is owned or licensed by Toast. You may use site materials only for personal shopping purposes. 14. Licence to Use Submissions

By submitting reviews, comments, feedback, images, or other content to Toast, you grant Toast a non‑exclusive, royalty‑free licence to use, reproduce, adapt, and publish that content for any purpose, including marketing and product development, without restriction or compensation.

15. User Conduct

You must not upload, post, or transmit material that infringes the rights of others, is unlawful, threatening, abusive, defamatory, obscene, offensive, or harassing, or encourages criminal conduct. You must not restrict or inhibit another user’s enjoyment of the site, damage or interfere with site functionality (including by transmitting viruses or harmful code), or breach any applicable standards or codes.

16. Account Responsibility

If you create an account, you are responsible for safeguarding your login details. You are liable for all activity under your account, including unauthorised use.

17. External Links

Our site may contain links to third‑party websites. Toast is not responsible for their content, practices, or products. Inclusion of a link does not imply endorsement. You rely on third‑party sites at your own risk. Parents and guardians are responsible for monitoring minors’ online activity.

18. Disclaimer of Warranties

Except as required under Australian Consumer Law, Toast provides this site and its contents “as is.” We make no warranties about accuracy, completeness, or reliability. All implied warranties, including merchantability and fitness for purpose, are disclaimed to the extent permitted by law.

19. Limitation of liability

To the maximum extent permitted by law, Toast is not liable for indirect, incidental, or consequential damages, including loss of profits, data, or goodwill. Our liability is limited to re‑supply of information or services, the cost of activation, or the amount paid by you for the product.

20. Indemnity

You agree to indemnify Toast, its directors, employees, contractors, and affiliates against any claim, demand, injury, damage, loss, expense, or liability, whether direct or indirect, arising from your use of the site, breach of these Terms, or infringement of third‑party rights.

21. Delivery Delays and Complaints

Delivery delays are not grounds for cancellation or compensation. Complaints must be lodged within seven days of delivery or activation. Toast’s liability is limited to re‑supplying or reactivating the product.

22. Force Majeure

Toast is not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, strikes, pandemics, or supply chain disruptions.

23. Termination

Toast may suspend or terminate your access at any time without notice. All indemnities, liability limitations, and licences survive termination.

24. Privacy and Data Security

Your use of our website is also governed by our Privacy Policy. Toast takes reasonable steps to protect your personal information, but you are responsible for ensuring your own devices and internet connection are secure when accessing our site.

25. Age Restrictions

Purchases must be made by individuals aged 18 or over, or with parental or guardian consent if younger. Toast accepts no liability for purchases made by minors without appropriate consent.

26. Reseller Restrictions

Toast products are intended for personal use only. Bulk purchases or resale of products without our prior written consent are prohibited.

27. Dispute Resolution

Before commencing legal proceedings, you agree to attempt to resolve any dispute with Toast through good‑faith negotiation or mediation. This clause does not limit your rights under the Australian Consumer Law.

28. No Waiver

If Toast does not enforce a right under these Terms immediately, this does not mean that right has been waived. Toast may enforce its rights at any time.

29. Assignment

Toast may assign or transfer its rights and obligations under these Terms to another entity, including in the event of restructuring or sale of the business.

30. Electronic Communications

By using our website, you consent to receive notices, invoices, and communications electronically. Toast will communicate with you primarily via email, and you agree that such communications satisfy any legal requirement for written communications.

31. Rights We Cannot Exclude

Nothing in these Terms excludes rights that cannot be excluded under the Australian Consumer Law.
